IRS Representation

 

We are proud to offer professional, third party, IRS representation.  

 

What is third party representation? 

Licensed Attorneys, CPA’s and Enrolled Agents can act on behalf of your organization before the IRS.    Authorization is formally granted by completing IRS Form 2848, Power of Attorney and Declaration of Representative.    

What are representatives authorized to do?

Authorizations can be granted for a specific purpose; i.e. a status check of a pending application or for more general matters such as the status of tax filings on behalf of the organization. 

Why is third party representation important?

There are several reasons.  Representation allows the authorized representative to receive and inspect tax information and to perform acts with respect to the tax matters described on Form 2848.  In simple language, it allows us, as your representative, to receive correspondence related to your Form 1023 or 1024, Application for Recognition of Exemption.   If for some reason you are unavailable or unable to respond to IRS inquiries, as your authorized representative we can respond to the IRS on your organization’s behalf or request an extension of time to respond.

Representation also authorizes the representative to discuss your application directly with the examiner assigned to review your application.   In complex determination cases, an experienced representative can provide the IRS examiner with background information, including citations of authority contained in the Internal Revenue Code (IRC), proposed, temporary and final regulations, revenue rulings and procedures, court case history, private letter rulings, and technical advice memorandum.

If your organization’s tax exempt status has been recently revoked, a licensed representative can determine what needs to be done to comply with the IRS and apply for reinstatement. 

Does Non Profit Advisor Group provide IRS representation for all clients?

No.  Representation is provided at the request of the taxpayer (applicant) and only after both parties complete IRS Form 2848.  In other words, you have the option of granting one of our licensed representatives power of attorney to represent your organization.  Conversely, we take our licenses seriously and will not represent taxpayers, organizations or applicants who are not acting in good faith or are unable or unwilling to provide information or details required or requested by the IRS.  

Will completing a Form 2848, (Power of Attorney and Declaration of Representative) authorize the representative to obtain and inspect my personal or business confidential tax information?

No.  Only matters specifically described are authorized.   If you have other tax matters needing representation, one of our licensed representatives can discuss those matters with you and determine a course of action.

Can I revoke a power of attorney? 

Yes.  Either the taxpayer or the representative can revoke the power of attorney at anytime.

Do all companies offer third party representation?

No.  Only licensed attorneys, CPA’s or Enrolled Agents admitted to practice before the IRS can represent third parties under Form 2848 (Power of Attorney and Declaration of Representative).   Company officers, full-time employees and immediate family members, when authorized by Form 2848, can discuss matters as specified with the IRS.  Click here to view IRS Form 2848, Power of Attorney and Declaration of Representative.
